Virginia ABC updated its retail tobacco permit guidance on September 11, 2026, and the headline for hospitality operators is a hard date: October 1, 2026. From that day forward, selling retail tobacco products without a permit may bring misdemeanor criminal charges.
The rule reaches further than tobacco shops. Under the new state law definitions, a “retail tobacco establishment” includes any grocery store, convenience store, gas station, kiosk, bar, or restaurant where retail tobacco products are sold to the public. Covered products include cigarettes, chewing tobacco, snuff, snus, heated tobacco products, liquid nicotine and nicotine vapor products, electronic smoking devices whether or not they contain nicotine, and accessories such as glass pipes and blunt or hemp wraps. Businesses that sell only cigars and pipe tobacco are not required to get the permit.
Cost depends on whether you already hold an alcohol license. Virginia ABC lists a one-time, non-refundable application fee of $300 for retailers with an existing ABC license and $400 for retailers without one, which covers the first 12 months. A separate permit is required for each location, and owners holding 10 percent or more of the business need a criminal background check. Existing ABC licensees who have not had a background check in the last 24 months will need a new one.
The detail most relevant to anyone who manages staff: the new laws require the permit applicant to attest that employees have been trained on ID checking, signage placement, prohibited acts, and penalties. Virginia ABC has launched a free online course called VERT (Virginia Education for Retailers of Tobacco) that covers those required elements. That attestation sits alongside, not in place of, the alcohol-side training Virginia already rewards. Operators who want their pour staff covered on the alcohol side can look at Virginia alcohol seller-server training, which is approved under Virginia ABC’s STAP program.
Applications are open now. Virginia ABC anticipates issuing permits within 20 to 30 days of receiving an online application, and says paper applications take longer. Any application approved before October 1, 2026 takes effect October 1, 2026 and expires September 30, 2027. Given the processing window and the criminal background check step, operators who sell vape or tobacco products alongside alcohol should not treat the end of September as the starting line.
